We create a database of company codes of ethics from firms listed on the Standard & Poor's 500 Index and, separately, a sample of small firms. The SEC believes that "ethics codes do, and should, vary from company to company." Using textual analysis techniques, we measure the extent of commonality across the documents. We find substantial levels of common sentences used by the firms, including a few cases where the codes of ethics are essentially identical. We consider these results in (...) the context of legal statements versus value statements. While legal writing often mandates duplication, we argue that value-based statements should be held to a higher standard of originality. Our evidence is consistent with isomorphic pressures on smaller firms to conform. (shrink)

This paper uses E. M. Forster’s novel Howards End to help articulate what I describe as a moral pluralist approach to moral conflict. Moral pluralism, I argue here, represents a way of responding to the moral conflicts we encounter in our lives, rather than the mere acknowledgment of their inevitability, as suggested by value pluralists like Isaiah Berlin. The tragic view of moral conflict epitomized by Sophocles’ Antigone and endorsed by most theories of value pluralism, tells us that we must (...) choose between moral commitments and reconcile ourselves to the moral regrets that inevitably follow from moral choice. The moral pluralist view, in contrast, suggests that we should seek means, however imperfect, of satisfying conflicting moral commitments and minimizing causes for moral regret. That view, I argue, drives the words and actions of Forster’s heroine in Howards End, Margaret Schlegel. Confronted with a battle between a willful patriarch and a self-righteous sister, a conflict that maps neatly onto the central conflict in Sophocles’ tragedy, Margaret refuses to take sides without refusing to make moral choices. And in doing so, she comes to exemplify an unexpected kind of moral heroism. (shrink)

When E. M. Forster published the novel Howards End in 1910, it was at the height of ‘the inheritance society’, and the gulf between rich and poor was great and problematic; a fact that Forster was very well aware of. Yet in spite of this, the main character in Howards End, Margaret Schlegel, is a financially independent rentier living off of the wealth of her ancestors, and her wealth increases when she is named the ‘spiritual heir’ of Ruth Wilcox and (...) thus inherits the house of Howards End. In this study, I argue that Forster shifts the focus from inherited money to inherited values in order to pardon a society of great inequality. Drawing on an aristocratic principle, Forster thus deals with inheritance as an inalienable and spiritual subject rather than as a legal and economic one. (shrink)

This paper focuses on the topic of evaluation of clinical ethics consultation. The concept of evaluation seems to contain an internal tension: On the one hand, evaluation is seen as distorting the conceptual and normative content of the case under scrutiny and, on the other, the evaluative act is the most important use of judgment and an inescapable part of everyday life. As such, we maintain that evaluation is essential.

Fetal ultrasonography has made women's and men's relationship to the fetus more equal. Drawing on information obtained from multiple conjoint interviews with 62 childbearing couples, I suggest that although women and men are both advantaged by fetal ultrasonography, expectant fathers' experience of the fetus is always enhanced, whereas pregnant women's experience may also be attenuated. For men, fetal ultrasonography is like a prosthetic device: an enabling mechanism that permits them access to a female world from which they have been excluded (...) because of their limited biological role in reproduction. For women, fetal ultrasonography is enabling, but it may also be a disabling mechanism that disrupts their privileged access to the fetus. (shrink)

Driven by an impetus to standardize, numerous checklists have been devised to address quality in qualitative research, but these standards and the mindset driving them offer no language with which to speak about taste, or the aesthetic sensibilities that play such a key role in evaluating the goodness of any object. In this article, quality appraisal in qualitative research is considered in the context of taste, that is, in the discernment involved in judging the value of research and in the (...) recognition of the key role reviewer preferences, sensibilities and membership in one or more taste communities play in these judgements. The evaluation of a study is accomplished by evaluating one or more reports from that study, and such reports may be conceived as art forms amenable to the same criteria for appraisal as poems or paintings. Taste implies judgements about the quality of objects and a person's ability to sift through and select from a store of knowledge that knowledge appropriate to judge its value. What binds a community of practitioners (here reviewers of qualitative studies) together is taste‐making, or the constant refinements of judgements concerning what constitutes good and bad practice. The history of political thought of the so-called »Cambridge School« is certainly only one of many methodological successors of the old German »Geistesgeschichte«. Yet it may be regarded as the latter’s most influential replacement. The essay discusses the relation between Quentin Skinner’s history of political thought and literary studies which leads to the differences between the approach promoted by the »Cambridge School« and the »Geistesgeschichte« of the inter-war years. The essay concludes by discussing the »Cambridge School’s« potential for literary studies (...) as well as the significance of literary texts for studying political thought and political ideas in history. This paper focuses on philosophical toy objects and neo-pataphysicist disciplines, everyday resistance by futility and play. Contemporary electromagnetic toys, smart objects and the Internet of Things will be compared to the seventeenth-century Wunderkammer objects. Historic naturalia, objects and actual toy gadgetry will all be unveiled as alternate W.A.S.T.E. (Pynchon 1964) communications devices, among Habsburg peers. A proof of evidence for the functions of futile toys as resistance objects is given through the presentation of electronic circuit board designs as new bachelor (...) machines, chindogus (useless objects), subcutaneous Radio Frequency Bijoux (RFID-implants) and game fashion, as introduced by the author. But what are the consequences of the use of futile toys on the streets of everyday life? Do they entail a sustainable nascent practice in arts? Who is allowed to play with the electromagnetic parallel worlds? Do electronic toys offer a parallel communications system in their futility? What is the actual role of electronic toys in an inverse trajectory backwards to their harbingers, which are philosophical toys, jeux bijoux (blingblings to play with), Wunderkammer-toys (for peers to establish links with Potlatch-like gifts to tighten social relations) and the Ludic Spielzeug (a toy which empowers the player to recognize the futile toy as tool of resistance and backtalk to given economic and discourse order)? This volume examines the ways in which the authors of the early Frankfurt School criticized, adopted and modified traditional forms of religious thought and practice. Focusing on the works of Theodor W. Adorno, Walter Benjamin, Erich Fromm, Max Horkheimer, Otto Kirchheimer and Franz Neumann, it analyzes the relevance of religious traditions and of the Enlightenment critique of religion for modern conceptions of emancipatory thought, art, law, and politics.

<b>Objectives:</b> To gather empirical data on how gender and educational level influence bioethical reasoning among medical students by analyzing their use of care versus justice arguments for reconciling a bioethical dilemma. <b>Setting:</b> University Departments of Medical Ethics, Social and Communication Psychology in Germany. Participants: First and fifth year medical students. Design and method: Multidisciplinary, empirical, 2-segment study of ethics in action: In intrapersonal Segment 1, the students were presented with a bioethical dilemma and then administered a 13-item questionnaire to survey (...) their individual preferences for care versus justice arguments in resolving the conflict. The survey questioned 6 justice, 6 care-related items and 1 socially critical item. Data were analysed by gender and year of medical school. In interpersonal Segment 2, the bioethical dilemma from Segment 1 was discussed in gender-mixed and gender-homogeneous groups. Coded transcripts were evaluated to identify prevalences in care versus justice reasoning. <b>Results:</b> Data on 462 medical students were evaluable (n=338 in Segment 1, n=168 in Segment 2, n=44 overlap). Gender and level of education had no effect on moral reasoning in intrapersonal Segment 1, but significantly affected reasoning in interpersonal Segment 2, where women significantly tended to use more care-orientated arguments. Justice arguments predominated the group discussions. <b>Conclusion:</b> Interpersonal contexts affect moral reasoning in medical students, probably by amplifying the socialisation relating to gender and educational level. Care orientation is associated with the female gender. Professional socialisation tends to reduce the diversity and richness of moral reasoning towards a more justice-weighted orientation. Medical ethics should teach both justice and care reasoning modes in order to broaden physicians' ability to reconcile bioethical dilemmas. (shrink)

When the original Dutch version of this book was presented in 1971 to the University of Leiden as a thesis for the Doctorate in philosophy, I was prevented by the academic mores of that university from expressing my sincere thanks to three members of the Philosophical Faculty for their support of and interest in my pursuits. I take the liberty of doing so now, two and a half years later. First and foremost I want to thank Professor G. Nuchelmans warmly (...) for his expert guidance of my research. A number of my most im portant sources were brought to my attention by him. During the whole process of composing this book his criticism and encouragement were carried out in a truly academic spirit. He thereby provided working conditions that are a sine qua non for every author who is attempting to approach controversial matters in a scientific manner, conditions which, however, were not easily available at that time. In a later phase I also came into contact with Professors L. M. de Rijk and J. B. Ubbink, with both of whom I had highly stimulating discussions and exchanges of ideas. Wie muss ein ethischer Beratungsdienst strukturiert sein, damit er in moralischen Konfliktsituationen im klinischen Alltag angefragt wird und die Ratsuchenden ergebnisorientiert unterstützen kann? Nach welchen Kriterien lassen sich die Beratungsgespräche auswerten und bewerten? Zur Beantwortung dieser Fragen werden theoretisch fundierte Konzepte ethischer Fallbesprechung aus Nimwegen, Leuven und Basel herangezogen; dies geschieht vor dem Hintergrund der Erfahrungen mit der über zehnjährigen Entwicklung der ethischen Arbeit im Ev. Krankenhaus Bielefeld (EvKB). Als Resultat stellen wir einen strukturierten, multidisziplinären Ansatz vor, mit dem in (...) den Beratungsgesprächen die ethischen Dimensionen unterschiedlicher Vorstellungen herausgearbeitet und möglichst einvernehmlichen Lösungen zugeführt werden. Am Beispiel des EvKB lässt sich zeigen, dass der ethische Beratungsdienst auch in Zeiten knapper Ressourcen implementiert und praktiziert werden kann und eine Gesprächskultur schafft, die zu neuen Zielvariablen führt; hier spielen der Perspektivenwechsel und die Prozessgerechtigkeit eine zentrale Rolle und liefern zugleich Ansatzpunkte für unsere eigene Evaluationsstrategie. Zum aktuellen Stand der Evaluation klinischer Ethikberatung wird die internationale Literatur kritisch gewürdigt. Erste konzeptionelle Ansätze und Ergebnisse einer eigenen Evaluationsstrategie werden vorgestellt. Durch die Offenlegung hoffen wir, die Auseinandersetzung mit diesen Themen zu intensivieren. Within the rough ground that is the field of education there is a complex web of ethical obligations: to prepare our students for their future work; to be ethical as educators in our conduct and teaching; to the ethical principles embedded in the contexts in which we work; and given the Southern context of this work, the ethical obligations we have to this land and its First Peoples. We put out a call to colleagues whose work has been concerned with (...) the pedagogies of professional ethics, the ethical burdens of institutional injustice, and the application of ethical theory to education’s applied fields. In the responses we received it can be seen that ethical concerns in education are broad ranging, covering terrain varying from the preparation of preservice teachers, ethics in higher education, early childhood and care, educational leadership, relational and communicative ethics. Perhaps it could also be argued that this paper demonstrates Gibbon’s observation that ‘Assumptions about the particularity of this time as new and ripe with opportunity to make a difference through philosophy of education are not new and there’s much to learn from the persistence of wanting to imagine that they are’. However, while the field of ethics is perennially concerned with human relations and pedagogical interventions to improve these, the responses collected here show that educational ethics is far from static. Educational ethics is a field that continues to develop in response to changing contexts. (shrink)

It must be admitted that there are some of us who “teach” Virginia Woolf and yet seem unable to learn from her. The secret of Virginia’s eminently readable prose style remains hidden from us. It is for this reason that I find it impossibly hard to read everything that Professor Marcus and some of her colleagues produce in such astounding abundance, and that, she may retort, is why she has found it impossible to read my biography of Virginia Woolf. In (...) a sense, she does not need to; she can imagine it and, thus, credit me with the statement that I considered my aunt “a minor British novelist, ranked somewhere below E. M. Forster as a writer of fiction” . Seeing that I made it clear from the outset of that biography that I would not attempt to assess the work of Virginia Woolf, seeing that I have been blamed for this abstention , and seeing that I have said absolutely nothing at any time that could possibly be construed in this sense, I think that we may well call this a master-stroke of the imagination.Also it is irrelevant. I accuse her of inaccuracy; she “replies” by asserting that I have bad taste. It seems a rather unconvincing form of defence. In fact, in her “reply,” which must be about as long as the article by which it was engendered, Professor Marcus can find so little in the way of evidence or argument with which to support those contentions which I have criticized that the reader must wade through page after page of completely otiose matter before coming to anything which seems to bear on the matter at hand. At last Professor Marcus tells us that she has written “two long essays in which I did at length and in detail exactly what he does here”; here, then, we come to her answer . The reader, who may be somewhat bewildered by so long a preface, may wish to be reminded what there is that needs to be answered. I maintain that Professor Marcus has neglected to notice that Margaret Llewelyn Davis was primarily Leonard Woolf’s friend rather than Virginia’s, that her relationship with Virginia was at times very uneasy, that Virginia was out of sympathy with politically minded women, and that Professor Marcus neglects to notice any of this because she fails to use the evidence of the diaries and the letters. When she does quote from a letter, she completely misunderstands it, just as she fails to understand Virginia’s use of the term “the woman’s republic” . This article deals with the notion of jurisdictional discourse, which, as a specific type of complex discourse, always poses a real challenge to translators. The authors present a contrastive analysis of the texts of legal decisions in French, German and Polish in order to demonstrate the difficulties in translation and the consequences which they entail, and to suggest a strategy for overcoming them. Firstly, the authors briefly compare the texts of judicial decisions indicating their characteristics both in terms of the (...) macrostructure of the text and in terms of syntactic and lexical units. Secondly, they explain the origin of the difficulties in translation resulting from the qualitative differences of the legal systems. Thirdly, the different types of difficulties are described and illustrated by practical examples, in order to make experienced translators and apprentice translators sensitive to them. The corpus used for the analysis consists of the integral and documented texts of the French, German and Polish judgments rendered in matters of civil law [37]. It should also be noted that the analyzed texts are comparable texts, which are a valuable tool for translators and allow them to acquire means of expression that are as natural as possible [40]. Regarding the methodology, the authors adopt for the analysis the contrastive method, borrowed from the theory of cultural transfer [15]. (shrink)

Charles Peirce, the founder of pragmatism, was a thinker of extraordinary depth and range - he wrote on philosophy, mathematics, psychology, physics, logic, phenomenology, semiotics, religion and ethics - but his writings are difficult and fragmentary. This book provides a clear and comprehensive explanation of Peirce's thought. His philosophy is presented as a systematic response to 'nominalism', the philosophy which he most despised and which he regarded as the underpinning of the dominant philosophical worldview of his time.
